Services are supplied subject to the conditions as stated below.

PRICES AND OUR TERMS:
Prices quoted are exclusive of VAT and subject to adjustment without prior notice.

Terms of payment will be divided into 5 separate payments on Swimming Pools and Koi ponds 3 payments on other contracts, including a 10% deposit before work commences and the outstanding balance between 5% payable on completion of the job.

The total price is the Contract price. If payment is not made as detailed above, the Contract will be delayed.

Payment to: B C Wagner.

Before any contract can take place, a credit check might be required.

SPECIFICATIONS AND CONDITIONS OF CONTRACT:
The Contract Price does not include (1) The handling of rock; (2) Cost of sumps or drains; (3) Cost of special schedule construction in clay or filled areas or soil of an unstable nature.
Pneumatic Tools: Will be charged for extra per day.
Blasting – Subject to a separate quotation.

The onus is on the Owner to establish the position of underground obstacles i.e. sewer pipes, water pipes, cables, drains, etc. In the event of the contractor damaging or destroying such obstacles, the cost of repairing or replacing shall be for the Owner.

The onus is on the Owner to ensure no servitude’s exist in relation to the position of a pool.

The Owner agrees to provide storage for all materials of the Contractor of a perishables nature (i.e. cement).

DAMAGE TO PROPERTY:
Although Garden Networks have the greatest respect for the Owner’s property, we do not hold ourselves responsible for any damage caused to fences, driveways, paths or gardens.

Garden Networks can’t be held liable in the event of any loss or damage to products after installation of the products.

PROVISION OF SERVICES:
The Owner shall be responsible to ensure an adequate supply of electricity and water for the purpose of the work and shall have no recourse against the Contractor for such costs. The Owner has to supply an outside electrical connection, with a circuit breaker on the main house board. The Owner shall be responsible for the provision of toilet facilities.

DELIVERY:
The Contractor shall not be responsible for any delays in the execution or the works occasioned by factors beyond the control of the Contractor and further retains the right to proceed with the work strictly in accordance with the Contractor’s plans.

REGISTERED OWNER:
The Owner warrants being the registered Owner of the Property where the work is to be executed. Should pool plans be required, the plans of the property to be provided by the owner, pool plans to be drawn by the contractor (this will be at an additional cost) and submitted by the owner.

OWNERSHIP:
It is specifically recorded that ownership of all equipment delivered or installed at the work-site remains vested in the Contractor until the Owner has made payment to the Contractor in full in terms of the Contract.

VARIATION OF CONTRACT:
No variations of the Contract shall be of force unless confirmed in writing.

GOODS TO BE DELIVERED BY GARDEN NETWORKS:
Deliveries will only be carried out in the Gauteng area and charged for extra.

If an item does not meet expectations, kindly advise as follows:
On arrival of your consignment, please check all items against the copy of your invoice and that all items have been received in good condition. Please clearly indicate any missing or broken item, on the invoice copy, which must be signed.
